The British Columbia Government Employees’ Union (BCGEU) recently described the court’s decision to dismiss an ex officio order filed by Gateway Casino against striking casino employees as a victory for all local unions.

A few days ago, a Supreme Court judge rejected the above-mentioned application. As previously written by the Casino Report, a civil claim filed in mid-September designated BCGEU, United Food and Commercial Workers Canada Area Number 401 (UFCW) and Jane Doe, John Doe and other “unknown people” as defendants in the case.

The main evidence that Gateway Casino relied on was a written statement confirmed by the oath submitted by General Manager Michael Magnusson. In September, Gateway Casino filed an application in an attempt to prevent pickers from breaking into the Penticton property and from accessing the casino. The hearing was held in Vancouver on Sept. 17.

But Justice Michael Tarmen denied the civil claim in a 13-page ruling.

As mentioned above, the BCGEU described the court’s ruling as a big win for all workers’ unions in picketing disputes across British Columbia, confirming workers’ right to freely express their beliefs. BCGEU Chairman Stephanie Smith has urged Gateway Casino to stop what she calls “cheap publicity tactics and frivolous legal tactics” and come back to the negotiating table.

About 675 unionized workers at Gateway Casino properties in Penticton, Camloops, Kelowna and Vernon have been on strike since late June. They have been asking for higher wages and have not been satisfied with the proposal put forward by Gateway Casino. Earlier this year, a company spokesperson said Canadian casino and gambling operators offered wage increases between 2.4% and 13% during their first year and have since increased by 2% annually.
